Terms of Service

1. Acceptance of Terms

By accessing or using the Benkol platform ("Service"), operated by Benkol ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Benkol is an AI-powered content generation platform that creates images, videos, carousels, and voiceovers based on user-provided references and briefs. The Service uses third-party AI models to generate content.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. One person or legal entity may not maintain more than one free account.

4. Subscriptions and Payments

Paid features require a subscription. Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days notice. Credits included in your plan expire at the end of each billing period unless stated otherwise. Extra credits purchased separately do not expire.

5. Free Trial

New accounts receive a 7-day free trial with a limited number of credits. We reserve the right to modify or discontinue the free trial at any time. Only one free trial per person or organization.

6. Acceptable Use

You agree not to:

  • Generate content that infringes on intellectual property rights of others
  • Create illegal, harmful, threatening, abusive, or hateful content
  • Generate deepfakes or misleading content depicting real people without consent
  • Attempt to reverse-engineer, circumvent, or exploit the AI models
  • Use the Service for spam, phishing, or other fraudulent activities
  • Resell or redistribute the Service without authorization
  • Exceed rate limits or abuse the API in a way that degrades service for others
  • Upload content that you do not have the right to use

7. Content Ownership and License

Your inputs: You retain all rights to content you upload (reference images, briefs, brand materials). You grant us a limited license to process this content solely for providing the Service.

Generated content: Subject to your compliance with these Terms and applicable law, you own the content generated by the Service for you. We do not claim ownership of your generated content. However, AI-generated content may not be eligible for copyright protection in all jurisdictions.

Our rights: We may use anonymized, aggregated usage data to improve the Service. We will not use your uploaded content or generated output to train AI models without your explicit consent.

8. AI-Generated Content Disclaimer

Content generated by the Service is produced by AI models and may contain errors, inaccuracies, or unintended similarities to existing works. You are responsible for reviewing all generated content before use. We do not guarantee that generated content is original, accurate, or suitable for any particular purpose.

9. Content Moderation

The AI models include safety filters that may refuse to generate certain content. We reserve the right to remove content or suspend accounts that violate these Terms or our content policies.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

You may cancel your account at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account deletion, except as required by law.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.
